It was noted at the meeting that the Bill (Reg.No,1166) proposes that the period of disability, resulting from a workplace incident or occupational disease, is added to the insurance record for eligibility for Retirement Benefit on an age-basis, and also to the insurance record for those suffering from exposure to harmful conditions and thus eligible to a Retirement Benefit on preferential terms..

 

The document envisages that those persons whose Retirement Benefit has already been fixed, are entitled to a recalculation of their entitlement consistent with the provisions of this Law, and subsequent recalculation of the amount of their Retirement Benefit.

 

At the same time, Committee members stressed, putting this legislative proposal into practice is impossible until several other matters have been resolved. Pursuant to the Law ‘On Obligatory State Retirement Insurance´, the monthly insurance premium, to an amount not less than the minimum established insurance premium, is grounds for including the relevant period into the insurance record. Therefore, the inclusion of the period of disability, resulting from an incident at a workplace or occupational disease, to the insurance record and entitlement to Retirement Benefit on an age-basis, requires that insurance premiums are paid for the person at issue. Hence a procedure should be established for such payments, specifying the payee and the funds from which these payments are to be made.

 

Committee members also noted that the regulation of the issue of inclusion of the period of disability, resulting from a workplace incident or occupational disease, to the insurance record before retirement age has been reached, is envisaged in the Bill,´ On Collection and Record of Unified Social Fee towards Obligatory State Social Insurance´, (Reg. No.0924), adopted by Parliament, as a basis for further deliberation, on 11 April 2007.
